Online payments submitted through hellokwcs.com should only be made after you have received an approved quote, invoice, or payment request from KW Creative Studios.

Online payments are processed by third-party processors such as Stripe. By paying online, you also agree to the processor’s applicable terms.

5. Project Scope

The scope of work is defined by the approved quote, proposal, invoice, or written project agreement. Work outside that scope may require additional fees and written confirmation before it begins.

6. Revisions

Revision allowances, rounds, and related fees are governed by the client’s approved quote, proposal, invoice, or written project agreement. Requests beyond the agreed revision framework may be treated as additional work.

7. Client Responsibilities

Clients are responsible for providing timely feedback, approvals, and materials needed to complete the work (such as logos, product information, brand guidelines, footage, music, or copy). Delays in client input may affect timelines.

8. Client-Provided Materials

If you provide logos, photos, videos, music, trademarks, product claims, or other materials, you represent that you have the rights needed to use and share them for the project. You are responsible for ensuring those materials do not infringe third-party rights. KW Creative Studios is not responsible for claims arising from client-provided content.

9. Project Timelines

Estimated timelines, if any, are set out in the approved quote, proposal, invoice, or written project agreement and may depend on timely client feedback and material delivery.

10. Cancellations

Cancellation terms are governed by the client’s approved quote, proposal, invoice, or written project agreement. If no separate cancellation terms are stated, KW Creative Studios may invoice for work already performed and non-recoverable costs incurred before cancellation is confirmed in writing.

11. Refunds

Refund eligibility, if any, is governed by the client’s approved quote, proposal, invoice, or written project agreement. Because services are custom, completed or in-progress creative work may not be fully refundable except as expressly agreed in writing.

12. Intellectual Property and Ownership

Unless otherwise stated in the approved quote, proposal, invoice, or written project agreement, ownership and usage rights for final deliverables are transferred or licensed according to that written agreement after applicable payment terms are satisfied. KW Creative Studios may retain the right to display completed work in portfolios, social media, and marketing materials unless a written agreement states otherwise.

Preliminary concepts, internal files, source project files, tools, workflows, and unused ideas remain the property of KW Creative Studios unless expressly assigned in writing.

13. AI-Assisted Creative Work

Some projects may use AI-assisted tools as part of the creative process (for example, concepting, image or video generation, editing support, or production assistance). Final deliverables are still produced under KW Creative Studios’ creative direction and project process. Ownership and usage rights for final deliverables remain as set out in the applicable written project agreement.

14. Limitation of Liability

To the fullest extent permitted by law, KW Creative Studios is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from the website or services. Our total liability related to a project will not exceed the fees you paid to KW Creative Studios for that specific project under the applicable written agreement.

15. Changes

We may update these Terms from time to time. The “Last updated” date reflects the latest version. Continued use of the website after changes are posted constitutes acceptance of the updated Terms for website use. Existing projects remain governed by their approved written agreements unless both parties agree otherwise in writing.
